Agreement to Terms

These Terms of Service (“Terms”) govern your access to and use of the website and tabletop exercise platform operated by Carley Fitzgerald, doing business as Everything's Fine: The Disaster Deck (“we,” “our,” or “us”) at https://thedisasterdeck.com(the “Service”).

By creating an account or using the Service, you agree to be bound by these Terms. If you are using the Service on behalf of an organization, you represent that you have authority to bind that organization to these Terms.

If you do not agree to these Terms, do not use the Service. The free demo at /play is available without an account and is subject to the same Terms.

Description of the Service

Everything's Fine: The Disaster Deck is a browser-based tabletop exercise platform for emergency management training. The Service includes:

  • Scenario-based tabletop exercises with action card mechanics
  • Live inject and complication events during exercises
  • After-action review (AAR) forms and AI-generated debrief content
  • Session hosting tools (join codes, group management)
  • Exercise history and AAR export

The Service is a training tool. It is designed to facilitate discussion and skill-building in a tabletop exercise format. It is not a substitute for formal emergency management plans, official NIMS or ICS training courses, or professional emergency management consulting.

Accounts and Subscriptions

To access paid features, you must create an account with a valid email address and maintain accurate account information. You are responsible for safeguarding your password and all activity that occurs under your account.

Subscription plans are billed annually. Your subscription automatically renews at the end of each billing period unless you cancel before the renewal date. Cancellation takes effect at the end of the current paid period — you retain access until then.

We offer a 30-day refund on annual subscriptions if you are not satisfied. Refund requests must be submitted within 30 days of the initial purchase date. Contact us at carleycritser@gmail.com to request a refund.

The free demo at /play is available without an account, subject to these Terms. Demo sessions are not saved or retrievable after the browser session ends.

Acceptable Use

You agree to use the Service only for lawful purposes and in accordance with these Terms. You agree not to:

  • Share your account credentials with users outside your licensed seat count
  • Resell, sublicense, or white-label the Service without written authorization
  • Use the Service to store classified, law enforcement-sensitive, or otherwise restricted information
  • Attempt to reverse-engineer, decompile, or extract source code from the Service
  • Use the Service in any way that could damage, disable, or impair its infrastructure
  • Represent that exercises conducted on this platform satisfy specific regulatory or certification requirements without independent verification
  • Use automated bots or scripts to access the Service

NIMS Alignment and Training Disclaimers

The Service is designed around National Incident Management System (NIMS) and Incident Command System (ICS) principles. Action cards, scenarios, and AI debrief content reference NIMS components and Emergency Support Functions.

However:We make no representation that use of this platform automatically satisfies FEMA, state, or local training requirements. Compliance with training mandates — including NIMS compliance requirements for federal grant eligibility — is the sole responsibility of the user and the user's organization.

The AI-generated debrief is produced by a large language model and reflects automated analysis of your exercise data. It is intended as a discussion-starting tool, not a professional evaluation. We recommend having qualified emergency management professionals review AI-generated content before it is submitted as official documentation.

Exercises conducted using this Service that are submitted as HSEEP-compliant exercises for grant or certification purposes are submitted at the user's own discretion and risk.

Your Data and Intellectual Property

Your exercise data belongs to you. We do not claim ownership of the content you create using the Service — scenarios you select, cards you place, notes you write, or assessments you complete.

You grant us a limited, non-exclusive license to store and process your data for the purpose of providing the Service, including sending exercise data to Anthropic's API when you request a debrief (as described in our Privacy Policy).

The Service itself — including its software, scenarios, action card content, inject content, and interface design — is owned by Carley Fitzgerald and is protected by copyright and intellectual property law. You may not reproduce, distribute, or create derivative works from our content without written permission.

Disclaimer of Warranties

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that the Service will be uninterrupted, error-free, or that defects will be corrected. We do not warrant the accuracy, completeness, or usefulness of any AI-generated content produced by the Service.

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, CARLEY FITZGERALD SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF YOUR USE OF OR INABILITY TO USE THE SERVICE.

OUR TOTAL LIABILITY TO YOU FOR ANY CLAIMS ARISING FROM YOUR USE OF THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE 12 MONTHS PRECEDING THE CLAIM.

Some jurisdictions do not allow the exclusion of certain warranties or limitation of liability, so some of the above limitations may not apply to you.

Indemnification

You agree to defend, indemnify, and hold harmless Carley Fitzgeraldfrom and against any claims, liabilities, damages, losses, and expenses (including reasonable attorney's fees) arising out of or in connection with: (a) your use of the Service; (b) your violation of these Terms; (c) your violation of any law or the rights of a third party; or (d) any content you submit through the Service.

Termination

We may suspend or terminate your account at any time for violation of these Terms, with or without notice. Upon termination, your right to use the Service ceases immediately. We will provide reasonable opportunity to export your data before termination where practicable.

You may terminate your account at any time by contacting us. Termination does not entitle you to a refund except as provided in our refund policy above.

Governing Law and Disputes

These Terms are governed by the laws of the State of Florida, without regard to its conflict of law provisions. Any dispute arising under these Terms shall be resolved in the state or federal courts located in Florida, and you consent to personal jurisdiction in those courts.

Before initiating any legal action, we encourage you to contact us first at carleycritser@gmail.com so we can attempt to resolve the matter informally.

Changes to These Terms

We may update these Terms from time to time. When we do, we will update the effective date at the top of this page. For material changes, we will notify registered users by email at least 14 days before the new terms take effect. Your continued use of the Service after the effective date constitutes acceptance of the updated Terms.
